This website is operated by Super Custom Tees. Throughout this site, the terms “we”, “us”, and “our” refer to Super Custom Tees. You understand and agree that by accessing or using the site and/or placing an order with supercustomtees.com or its sister sites, you are entering into a binding legal agreement on the terms outlined here. Furthermore, you agree to use the site in accordance with this User Agreement.

Super Custom Tees reserves the right to modify and make changes to the site and this User Agreement at any time without prior notice at its sole discretion.

Intellectual Property Rights

Super Custom Tees respects the intellectual property rights of both users and third parties. By using the site, you agree to comply with the Intellectual Property Policy of Super Custom Tees, which is incorporated by reference. If you intend to resell products created using Super Custom Tees' services, you confirm that you have the legal rights to the intellectual property and that your resale activities are authorized. You agree to indemnify Super Custom Tees for any and all legal or financial consequences resulting from the production of your designs for the custom products you are creating.

Limitation of Liability / Indemnity

Governing Law

This User Agreement shall be governed by the laws of the State of Maryland, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from or related to your use of the site, this User Agreement, or your dealings with Super Custom Tees shall be resolved exclusively in a court in Maryland, either in a state court or a federal court located in the United States District Court for the District of Maryland. Both parties agree to submit to the jurisdiction of such courts and waive any objections to venue.

Arbitration Clause and Class Action Waiver

Disputes related to our services, these Terms, or our Privacy Policy will be resolved through binding arbitration rather than in court. The arbitration will be conducted in Maryland by a neutral arbitrator. If the dispute involves a consumer, arbitration will be held in a location convenient to the consumer.

By agreeing to these terms, you waive your right to a trial by jury or to participate in any class action lawsuit. Claims must be filed within one year after they arise.

Affiliate Program Terms and Conditions

The following terms apply to individuals who participate in the Super Custom Tees affiliate program. By joining the program, you agree to the terms outlined below:

1. Registration Approval
   Super Custom Tees reserves the right to approve or reject any affiliate registration at its discretion.
2. Affiliate Links and Coupons
   Affiliates will receive automatically generated affiliate links. If you are assigned a coupon code, you will receive commission on sales using that code, but you cannot combine affiliate link clicks with a coupon for double commission.
3. Acceptable and Unacceptable Use
   Affiliates should engage in ethical marketing practices. Unauthorized activities, such as spamming or misleading customers, are prohibited.
4. Commissions and Payment
   Affiliates will receive a commission based on sales referred by their links, excluding taxes and shipping costs. Payments will only be made for successful transactions, and chargebacks or refunds will negate commission eligibility.
5. Marketing Tools
   We may provide affiliates with promotional tools like banners or logos for use on affiliate websites or social media.
6. Cookies
   We use cookies to track clicks on affiliate links, with a cookie lifespan defined in the affiliate registration. If a customer clears their cookies or disables them, commissions may not be tracked.
7. Removal from Affiliate Program

Mobile Terms of Service

The Super Custom Tees mobile messaging service (the "Service") is operated by Super Custom Tees (“Super Custom Tees,” “we,” or “us”). By using the Service, you agree to these terms and conditions (“Mobile Terms”). We may modify or discontinue the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following any changes will constitute your acceptance of those changes.

By consenting to Super Custom Tees' SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Super Custom Tees through your wireless provider to the mobile number you provided, even if your number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (such as order updates or account alerts). Promotional messages may include special offers, promotions, and marketing messages (e.g., cart reminders).

You understand that signing up for the Service is not a condition of making a purchase, and your consent is voluntary. You can choose not to participate without affecting your ability to make purchases on Super Custom Tees.

We do not charge for the Service, but message and data rates may apply. You are responsible for all charges associated with text messaging imposed by your wireless provider. Message frequency may vary, and you should check with your mobile provider for details regarding any applicable charges.

We may change the short code or phone number used to operate the Service at any time and will notify you of such changes. You acknowledge that any messages (including “STOP” or “HELP” requests) sent to a changed short code or number may not be received, and we will not be liable for any failure to honor requests sent to such numbers.

The wireless carriers that support the Service are not responsible for delayed or undelivered messages. You agree to provide us with a valid mobile number and notify us if you get a new number. If you change your number, you must sign up for the Service again with your new number.

To the extent permitted by applicable law, Super Custom Tees will not be liable for any failure, delay, misdirection, or error in delivering information sent via the Service, or for any actions you may or may not take based on such information or the Service.

We respect your privacy and will handle your data accordingly.

Miscellaneous

If any provision of this User Agreement is declared illegal or unenforceable by a court of competent jurisdiction and cannot be modified to be enforceable, that provision will immediately become null and void, while the remainder of the User Agreement will remain in full force and effect. If a provision is found to be unenforceable, the party benefiting from that provision may modify it to make it enforceable.

The headings in this User Agreement are for convenience only and do not affect its interpretation.

If Super Custom Tees waives or fails to enforce any rights under this User Agreement on one occasion, it does not mean those rights are waived for all future occasions.
